Kawaskimhon is a nêhiyawêwin (Cree language) word that means “speaking with knowledge”. This national moot is unique in that it centers Indigenous legal orders alongside federal, provincial, and international law. It is consensus-based and non-adversarial. Allard teams were extremely prepared and presented excellent position papers in advance of the moot, followed by a strong negotiation skills and advocacy on behalf of the parties they represented at their respective tables. |

The Allard Law team performed excellently in both their union and employer side arguments. The judges in both panels complemented the quality of their presentation, stressing their excellence in delivering their arguments clearly and with authenticity. By all accounts it was a very close decision with our team almost qualifying for the final. The Allard Law team placed second overall at the Canadian Qualifying Rounds of the 2022 Philip C. Jessup International Law Moot. The team performed incredibly well through six tough preliminary rounds against the Lincoln Alexander School of Law, the University of Alberta, the University of Manitoba, the University of Toronto, Queen’s University, and the University of New Brunswick. They advanced to the finals in third place with a 5-1 record, with their sole loss coming against U of T. The team faced the University of Windsor in one of the two finals held Saturday and won, thus finishing as the First Runner Up behind U of T. All four finalists (Western University being the other) have advanced to represent Canada in the Global Rounds starting March 25. The team’s spectacular performance marks the first time Allard Law has advanced to the Canadian finals in close to 10 years, and much longer since the team qualified for the Global Rounds through the national competition. The team also received awards for their written advocacy by winning Second Place Respondents Memorial and Fourth Place Overall Memorials. Spencer Taylor-Robins also tied for the sixth place oralist in the competition. |

The Kawaskimhon ("Speaking with Knowledge") Aboriginal Rights Moot is a non-competitive national moot focusing on Indigenous legal issues and peoples in Canada. The Kawaskimhon is a great opportunity for students to engage with issues of importance to Indigenous legal orders, Indigenous laws and Aboriginal rights in Canada. It is a popular and intensive experience for those students selected to form the team for Allard Law each year. A different law school hosts the Kawaskimhon each year. Participants include students from most Canadian law schools (in teams of 2 to 4 students) and facilitators (faculty advisors, community members, elders) from across the country. The moot problem is assigned by the host institution in December or early January, and the teams work on written documents such as position papers or factums after the problem is assigned. The moot itself is held in early March, over the course of two or three days. Often, the host law school prepares a cultural night (which usually includes a banquet, singers and dancers, etc.). Kawaskimhon teams are expected to work toward reaching consensus on the issues. Previous moots have addressed such issues as band membership rights, shared jurisdiction or overlaps, the effects of hydro projects, Métis rights, Gladue submissions, and jurisdictional issues on and off reserve. Students are assessed a pass/fail mark based on their research, written materials and oral presentations at the Kawaskimhon. The Kawaskimhon National Aboriginal Moot is unique among moot court competitions in the world, in that it is conducted in accordance with Aboriginal customs of peaceful negotiation and consensus-building rather than adversarial competition. There are no competitive awards, but the moot is invaluable in giving Indigenous students and students interested in Aboriginal law an opportunity to forge bonds with each other and deepen their understanding of Indigenous legal issues. |

The winners of the Peter Burns Moot competition were Mark Bakhet, Lisa Baek, Kelvin Zhu, and Kasra Behnampour. Individual award winners at the Competition were Timothy Chang for best cross-examination, Ryman Yeung for best jury address, and Kasra Behnampour won the Spirit of the Burns Award. The Allard School of Law successfully hosted the Western Canada Moot (the MacIntyre Cup) in 2021 where the series of trial moots among Western Canadian Law School were run virtually. The competition was Judged by Justice Jennifer Duncan of the British Columbia Supreme Court and Judge Jennifer Lopez of the British Columbia Provincial Court.
