The Federal Indian Day School Class Action Settlement was announced on March 12, 2019, and is a nationwide class action lawsuit against Canada for the harm survivors suffered at the hands of federally operated Indian day Schools. 
Under the class action settlement, survivors could file claims for compensation on a tiered system for harms suffered, 

Level 1 harms- $10,000
Level 2 Harms - $50,000
Level 3 Harms - $100,000
Level 4 Harms - $150,000
Level 5 Harms - $200,000

The ICLC has assisted all clients with writing as detailed a narrative as possible from the days spent at Indian Day School. We encourage a narrative to be written, because in the writing of the narrative a Level of Harm is determined.  In our opinion almost 100% of those in Indian Day school were either at a Level 4 Harm, or Level 5 Harm.

Between 1951 and 1991, First Nation and Inuit children were taken into care and placed with non-Indigenous parents where they were not raised in accordance with their cultural traditions nor taught their traditional languages. This dark chapter in Canada’s history is commonly referred to as the “Sixties Scoop.” The Class Action argues that those affected by the Sixties Scoop suffered significant harms as a result of these practices–specifically the loss of their cultural identity.

• The National Settlement between the Government of Canada and plaintiffs representing the group of Sixties Scoop Survivors who constitute “Eligible Class Members” was approved in December 2018.

The settlement included people who:

• Are registered Indians (as defined in the Indian Act) and Inuit as well as people eligible to be registered Indians; 
• Were removed from their homes in Canada between January 1, 1951 and December 31, 1991;
• Were considered permanent wards of the government; and
• Were placed in the care of non-indigenous foster or adoptive parents.

• Courts have approved a settlement between Canada and certain First Nations and their members subject to a drinking water advisory that lasted at least one year between November 20, 1995, and June 20, 2021.
• The key allegation was that Canada had breached its obligations to First Nation communities and its members by failing to ensure that reserves have clean water. It was further alleged that the Canadian Government breached its fiduciary duties and various rights under the Canadian Charter of Rights and Freedoms.
• On October 8, 2019, the courts granted the class action certification.
• The settlement includes commitments to fund infrastructure construction, operation, and maintenance to help Class Members enjoy regular access to safe drinking water in their homes. 
• Additionally, First Nation Bands may opt into the class action, providing the bands with an opportunity to have their stories heard in the hopes of advancing the rights of their communities. 
• Individuals who participate in the class action are giving up their rights to sue Canada for the claims resolved by the First Nations Class Action Settlement. The settlement will not bind first Nations who choose not to participate.
• The Indigenous Community Legal Clinic has only assisted with a couple of applications since the start of the settlement.

• The Millennium Scoop class action is a lawsuit against the Canadian Government on behalf of off-reserve Indigenous children and families who say the Government discriminated against and harmed them amid the Millennium Scoop.

The discrimination outlined in the class action has taken two forms:

• First, the Government has denied proper funding to child welfare agencies responsible for the protection and well-being of First Nations children. This denial of adequate funding has directly contributed to the epidemic numbers of First Nations children on reserves being removed from their homes and communities and placed in state care – a phenomenon referred to as the "Millennium Scoop."
• Second, the Federal Government has failed to honor Jordan's Principle. Jordan's Principle is a legal requirement for the Federal Government to provide First Nations children with necessary services and products regardless of which level of Government must eventually pay for those products or services. In breach of Jordan's Principle and constitutional equality rights, the Government has delayed or denied essential services and products to tens of thousands of First Nations children living both on and off-reserve.
• Late last year, Canada finally agreed to negotiate an agreement to end its discrimination against children living on reserve. Those negotiations resulted in a $40 billion Agreement in Principle finalized on December 31, 2021.
• The final settlement agreement determines the compensation amount, which is subject to approval by the Canadian Human Rights Tribunal and the Federal Court of Canada.

Murphy Battista LLP and Gowling WLG have filed a proposed class action against the Government of Canada (“Canada”) concerning the apprehension of Indigenous children and youth, living off-reserve, by child welfare agencies, and their placement in the care of individuals who were not members of their Indigenous community, group or people.

• The Statement of Claim, initiating this proposed class action, was filed in the Federal Court on June 10, 2020. An Amended Statement of Claim was filed on January 14, 2021.
• Oral submissions of the parties were made April 12 and 13, 2022.
• The proposed class action was certified as a class proceeding by the Federal Court of Canada on June 17, 2022

Koskie Minsky LLP along with Cooper Regel (a member of Masuch Albert LLP), commenced a class action on January 25, 2018 against the Attorney General of Canada alleging that its operation of “Indian Hospitals” was negligent and breached fiduciary duties owed to Indigenous People.
This class action was certified on January 22, 2020.

The classes are defined as follows:

• Primary Class means all persons who were admitted to an Indian Hospital during the Class Period; and
• Family Class means all persons who are a spouse or former spouse, child, grandchild or sibling of a member of the Primary Class and the spouse of a child, grandchild or sibling of a member of the Primary Class.
