Changes in the regulation of legal services around North America open up new opportunities to expand and enhance access to justice. What does research tell us about how this might happen? And what do we know about how long noticeable impacts might take to manifest?
As 2021 begins, there may be reasons for optimism that regulatory reforms in the legal services field may help to improve access to justice. The Law Society of BC’s recent announcement of a “legal services innovation sandbox” is a significant event that follows other notable developments elsewhere in Canada and the United States. But will these developments actually lead to improved access to justice? Against the backdrop of these regulatory developments, this talk will explore a novel, person-centred normative conception of access to justice to reinvigorate legal service reforms. And it will suggest an example of how that normative conception could be realized in practice in BC.
