
Responses to climate change and other environmental and social sustainability issues implicate two fundamental debates in corporate law. The first concerns the appropriate role and scope of regulation in shaping corporate purpose. The second, closely intertwined with the first, pertains to corporate convergence—namely, the extent to which corporate governance practices should or will align globally. Financial market intermediaries addressing ESG issues are under-appreciated protagonists in these debates. By deciding what constitutes a sustainable financial asset, ESG intermediaries directly and indirectly determine companies’ access to capital. In this talk, Professor Stephen Park from the University of Connecticut will discuss how ESG intermediaries influence corporate sustainability and the role of ESG regulation in leveraging their role as a catalyst for corporate sustainability convergence.
