Event Description
The goal of Bill C-9, passed late last year, was to enhance public confidence in the administration of justice by modernizing the complaints and discipline process for federally appointed judges. This presentation will be a synthesis of two forthcoming articles co-authored with Professor Sheila Wildeman. First, it will introduce a normative framework for assessing judicial complaints and discipline regimes. Second, it will deploy this framework to identify several positive aspects of Bill C-9. Third, it will apply the same framework to highlight several serious weaknesses with the legislation arguing that these flaws arose because the architects of the legislation succumbed to crisis thinking.
