
Lecture by Aminollah Sabzevari, a lawyer at the Department of Justice Canada. Amin represents the Federal Crown in large insolvency related proceedings under the Bankruptcy and Insolvency Act and the Companies' Creditors Arrangement Act and also teaches two courses in the business law concentration at Allard (Insolvency Law and Creditors' Remedies).
Section 172.1 of the Bankruptcy and Insolvency Act was introduced by Parliament to prevent the improper use of the bankruptcy system by individuals with significant personal income tax debt. The onus is placed on the tax driven bankrupt to establish they are an honest but unfortunate debtor. This talk will review the mandatory factors the Court must consider in a tax driven bankruptcy, the elements of each bankruptcy as a personal story, and the underlying tension between the fresh start principle, rehabilitation, and preventing the abuse of the bankruptcy system.
