Join the Climate Migration research group for a presentation examining how the right to a healthy environment, rooted in international human rights and environmental law, can help fill protection gaps for climate and environmental migrants.
Despite dire warnings from the IPCC, international law still lacks adequate safeguards for those displaced by climate-related events. In this talk, Mojan Farshchi proposes a hybrid legal approach that integrates this right into both international refugee law and the complementary protection framework. She examines how it can be applied to internal protection assessments and used to lower factual thresholds in line with scientific evidence. Framing climate migration through this widely recognized human right offers a coherent strategy for UN bodies, states, and decision-makers to respond to the crisis. The talk will also touch on recent developments, including the International Court of Justice’s ruling on climate change.
